International Criminal Court (ICC) has decided rule 68 will not apply in the cases against Deputy President William Ruto and Joshua Sang.
The ICC appeals chamber found that Rule 68 was applied retroactively in the Ruto and Sang.
The appeals Chamber noted that the Trial Chamber committed legal error in interpreting ‘detriment’ too narrowly and hence reversed the decision.
The recanted testimonies/ evidences submitted by The Office of the Prosecutor will not be used in the Ruto-Sang case.
This is a big win for the two because without Rule 68 the prosecutor has no evidence making her case weak.
The decision was made unanimously.
